So, Kita and I showed up at court at 8AM, the appointed hour.
We were told that we would know days in advance if the motion to dismiss had been approved, but had heard nothing.
Our attorney Sean Petersen met us with his assistant and explained that the City Atty had filed an objection to our motion to dismiss, referring to us as a “threat to public safety” where he claims we are the same as a store selling beer to a minor! Yes, what a joke!
Anyway, regardless of this adult silliness (paid for at public expense) even if the judge were to give it some credence, in addition to no part of the law being applicable to the facts, finally, there is no way that intent can be demonstrated and that of itself pretty much ends the deal as intent is a mandatory ingredient for a criminal offense.
My atty sent a reply to the court re: the City Atty’s objection. I have yet to receive these doc. but am told they are forthcoming.
So, today my atty. filed a motion for the judge to decide the motion that the City rejected and I am told that in a week or two it should be decided by the judge or that he might call us in to court so that he can ask some questions of (whoever) before making his decision to accept the motion to dismiss the charges or refuse to accept the motion and move the case ahead to an actual trial.
The idea that any judge would send this to trial is simply ludicrous!
Of course the idea that any head of a detectives unit would be so lame as to recommend such idiotic charges in the first place and then that a city atty would be so lame as to consider anything but to offer us an apology over such charges is equally ludicrous and insane – and juvenile.
So I can only imagine a trial if the judge is so bored out of his mind that he thinks it might be amusing for him to watch the city atty and the city cops get humiliated out of their socks in his court.
Other than that, I expect a dismissal.
As in my last update regarding Lt. Falslev and his personal vendetta to “get” me for my crime of not cowering before his supremeness, today we were also blessed with the following information from our attorney.
He said that one of the things that has the City Atty still worked up a bit is the AF Police (meaning of course Lt. Falslev – perhaps Chief Call as well) have been complaining to him (apparently often) that I have been telling (get this) other AF Cops that the AF Police are “harassing” us.
I’d say, well, whoop-de-do!
I haven’t been doing that of course, unless I get asked, which is pretty damn rare; I can’t really even recall once actually, except of course for Lt. Falslev himself who I did tell many times that he was just harassing us and trying to intimidate us – and – also those cops who might read this website.
I would say to “the police” who are whining to the city atty about us “saying things” about them – What a bunch of wusses and shin kicking sissies!
Anyway, in spite of their crybaby behavior, the fact remains that they in fact ARE harassing us.
Not only us but also anyone else they can get their grubby little (the law’s what I say it is) hands on in the community.
We have met tons of people since January who have had similar harassment and intimidation practiced on them by these exact same cops (the two head cops in AF)!!!
It’s a real community shake down racket, disguised as public safety (write lots of tickets) and by inflating all the charges, ordinary law abiding citizens are easily scared (intimidated) into jumping at a plea bargain to a lesser charge and smaller fine.
In this scenario, of course the people plead guilty (to anything) and nothing has to be proved – period.
Shandi’s atty told me that 99 out of 100 of his cases are settled by a plea agreement and never go to trial.
That means easy money, low paperwork, and you don’t have to ever prove a damned thing.
What a deal!

I can just imagine Lt. Falslev every day calling up the county attorney (Jeff Buhman) and the city atty (Tucker Hansen) and crying and demanding they find me and shandi guilty of something, anything (but it’s gotta be something bad – morally evil) and just freaking out that they really would rather make the whole thing disappear instead!
It will be a good day for America (and Utah) when these worms get turned.
