Yup.
The felonies were dismissed and though Shandi pled “no contest” to a reduced misdemeanor charge of Indecent Public Display the plea bargain stipulated that there were no fines, penalties or jail time and the charge will be dismissed entirely in 6 months.
I have to admit I was a bit upset that Shandi was so intimidated that she would plead guilty to something she did not do, just to get the guaranteed dismissal when the judge was so ready to dismiss the case as having no merit that same day in court.
In the end, though not as tidy and clear cut as I would have preferred, the outcome is the same and American Fork City’s merit-less charges have been established as such.
Lt. Falslev fought to the end, demanding that the County Atty. stick with the felony charges, later agreeing to enter an agreement to reduce the charges to 4 Class A Misdemeanors and mandatory jail time, but the County Atty finally basically told Lt. F. to “shove it” – that they were going with one misdemeanor and no penalties.
